These Terms and Conditions govern the use of the myHotelManager Application (hereinafter referred to as the "Service"), provided by METASOFT 3D SRL. By accessing or using the Service, you agree to comply with these Terms.

1. Acceptance of Terms

By creating an account and using the Service, you (as the "User") accept and agree to comply with these Terms, the Privacy Policy, and any additional guidelines or rules posted in the Application.

2. Service Offered

myHotelManager is a software application designed for managing hotel/guesthouse activities, including, but not limited to, reservation management, room allocation, customer records, and report generation.

3. Registration Conditions and Account Usage

3.1. Account Data:

Upon registration, the User must provide complete and accurate data (Hotel/Guesthouse Name, Owner Name, Address, Email, Phone).

3.2. Account Security:

• The User is solely responsible for maintaining the confidentiality of the password and login credentials.
• The User agrees to immediately notify METASOFT 3D SRL in case of any unauthorized use of their account.
• METASOFT 3D SRL will not be liable for any loss or damage resulting from the User's failure to comply with this section.

3.3. Usage Restrictions:

The User agrees not to use the Service for illegal, fraudulent activities or activities that violate the rights of third parties.

4. Intellectual Property

The myHotelManager application, including, but not limited to, the source code, design, logos, and content, are the exclusive property of METASOFT 3D SRL and are protected by copyright and intellectual property laws. The User is granted only a limited, non-transferable, and non-exclusive right to use (license) the Service, in accordance with these Terms.

5. Payment and Billing

If the Service involves a subscription or fee, the following applies:

• Billing cycle: The subscription is monthly/annual, with automatic recurring payment. It will continue and automatically renew each month until you choose to cancel the service (unsubscribe).
• Payment method: Payments are made online, using a valid bank card, through the payment processor Netopia Payments. Transactions are encrypted, secured, and conducted in complete safety.
• The Hotel Manager Service provides digital content that is not delivered on a physical medium (software as a service).

6. Service Termination

METASOFT 3D SRL may suspend or terminate the User's access to the Service, with or without prior notice, if the User violates these Terms and Conditions. The User may request account deletion at any time.

7. Limitation of Liability

METASOFT 3D SRL makes every effort to ensure optimal operation of the Service, but does not guarantee that the Service will be uninterrupted, error-free, or completely secure. METASOFT 3D SRL will not be liable for any direct, indirect, incidental, or special damages resulting from the use or inability to use the Service.

8. Applicable Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of Romania. Any dispute arising from or in connection with these Terms will be resolved by the competent courts of Romania.

9. Modifications to Terms

METASOFT 3D SRL reserves the right to modify these Terms and Conditions at any time. Modifications will take effect within 15 days of notifying the User or publishing in the Application, except for modifications required by law or for security reasons, which apply immediately.

10. Processing of Personal Data

To the extent that the User enters personal data of third parties into the Application (e.g., tourists, employees), the User acts as Data Controller, and METASOFT 3D SRL acts as Data Processor.

METASOFT 3D SRL undertakes to:

• process data exclusively according to the User's instructions (through application/database functionalities);
• ensure the security of stored data;
• not use this data for its own marketing purposes;
• delete data upon account deletion request.
